Marie Briswalder

Marie Briswalder heads up the business law department, advising and litigating on all matters relating to the day-to-day commercial aspects of businesses: contracts (general terms and conditions of sale/CGS, commercial leases, annual negotiations, etc.), competition (unfair competition, parasitism, breach of exclusivity clause, breach of contract, etc.), distribution (distribution network, franchising, commercial agents), consumer affairs, personal data, intellectual property, ICT (information technology) and regulations (business regulations/product regulations).

She has developed particular expertise in post-sale disputes (GAP, questioning of the sale, withdrawal of partners, de facto management and action to cover liabilities, etc.) and disputes concerning eviction compensation for commercial leases.

Marie also regularly assists companies in arbitration disputes.

She has been immersed in various national and international companies within legal departments and is therefore familiar with the expectations of operational staff (mainly to anticipate and reduce risks on the one hand and to get out of a situation quickly on the other). Above all, while respecting the legal framework, she seeks to offer her clients practical and effective solutions.

It is also involved in inspections by the competition authorities (Autorité de la concurrence), the DGCCRF (or its branches, in particular the DDPP), the CNIL or the DREETS, as well as in the notification of mergers.

Marie is also committed to creating value through the legal profession in start-ups, through a partnership with the Digital League, and to training young lawyers.
